DO I HAVE A DEFENSE TO DUI CHARGES?
There are many ways to attack drunk driving charges. However, it’s important to contact a lawyer as soon as possible to investigate your case, interview any witnesses and preserve evidence.
Some of the most common defenses in DUI/DWI cases include:
- Challenging the stop: Police can’t pull you over just because they feel like it. If they don’t have reasonable suspicion that you have committed an offense, the stop is illegal and the case will be thrown out.
- Challenging the breath test: In Kentucky, police must administer the Breathalyzer test within two hours of when you were driving the vehicle. Many times they don’t.
- Challenging the accuracy of the machine: Breathalyzer machines have a chip in them that records malfunctions. Rather than relying on the officer’s written report of accuracy tests, I will obtain the chip from Frankfort to verify the results.
