CONSEQUENCES FOR DRUG CRIMES

Possession of marijuana, except in large quantities, is a misdemeanor in Kentucky. It is still punishable by up to 12 months in jail.

Possession of drug paraphernalia for the first time is also a misdemeanor. However, if you plead guilty to a drug paraphernalia charge, the next time you are caught with drug supplies such as a marijuana pipe or rolling papers, it will be a felony charge.

Possession of drugs such as cocaine, crack cocaine, methamphetamine and heroin are felonies, meaning that you will lose your right to vote, possess firearms and serve on juries. You will also likely face prison time. Possession of cocaine is punishable by incarceration for one to five years. Drug trafficking is punishable by serving five to 10 years in prison.

Misdemeanor convictions can often be expunged from your criminal history, but felony convictions are forever.
